PURPOSE OF DATA PROCESSING AND LEGAL BASIS<\/strong><br \/>\nWe process personal data about you for the purpose of your application for an employment relationship, insofar as this is necessary for the decision on the establishment of an employment relationship with us. The legal basis for this is Art. 6 para. 1 lit. b), Art. 9 para. 2 lit. b), Art. 88 GDPR, \u00a7 26 BDSG in conjunction with state law, \u00a7 164 SGB IX. Furthermore, we may process personal data about you if this is necessary to defend against legal claims asserted against us in the application process. The legal basis for this is Art. 6 para. 1 lit. f) GDPR; the legitimate interest is, for example, a burden of proof in proceedings under the General Equal Treatment Act (AGG). If there is an employment relationship between you and us, we may process the personal data already received from you for the purposes of the employment relationship in accordance with Section 26 (1) BDSG if this is necessary for the performance or termination of the employment relationship. We also collect further data that will be required for the execution of the employment relationship. This includes, for example, data required for payroll accounting.\n<p>&nbsp;<\/p>\n<strong>3. CATEGORIES OF PERSONAL DATA<\/strong><br \/>\nWe process data in connection with your application. This may be general personal data (such as name, address and contact details), information about your professional qualifications and schooling or information about further professional training or other information that you provide to us in connection with your application. We may also process job-related information that you have made publicly available, such as a profile on professional social media networks.\n<p>&nbsp;<\/p>\n<strong>4. RECIPIENTS OF YOUR DATA<\/strong><br \/>\nYour personal data from the application will only be processed by us; there are order processing agreements with service providers such as the host provider, maintenance personnel for our servers or data carrier disposal companies in accordance with Art. 28 GDPR.\n<p>&nbsp;<\/p>\n<strong>5. TRANSFER TO A THIRD COUNTRY<\/strong><br \/>\nA transfer to a third country is not intended.\n<p>&nbsp;<\/p>\n<p><strong>6. STORAGE OF YOUR DATA<\/strong> We store your personal data as long as it is necessary for the decision on your application. If an employment relationship is not established between you and us, we may also continue to store data if this is necessary to defend against possible legal claims. In this case, the application documents will be deleted two months after notification of the rejection decision, unless longer storage is required due to legal disputes. If an employment relationship is established, we store all data required for the execution of the employment relationship. Such data will be deleted after termination of the employment relationship, unless there are statutory retention obligations that require us to store your data beyond the duration of the employment relationship.<\/p>\n<p>&nbsp;<\/p>\n<strong>7. YOUR RIGHTS<\/strong><br \/>\nAs an applicant with us, you have the following data protection rights, depending on the individual situation, and you can contact us at any time to exercise them:\n<p>a. Information You have the right to obtain information about your personal data processed by us and to request access to your personal data and\/or copies of this data. This includes information about the purpose of use, the category of data used, its recipients and authorized persons and, if possible, the planned duration of data storage or, if this is not possible, the criteria for determining this duration.<\/p>\n<p>b. Rectification, erasure, or restriction of processing: You have the right to request that we immediately rectify any inaccurate personal data concerning you. Taking into account the purposes of the processing, you have the right to request that incomplete personal data be completed\u2014including by means of a supplementary statement.<\/p>\n<p>c. Right to object Insofar as the processing of personal data concerning you is based on Art. 6 para. 1 lit. f) GDPR, you have the right to object to the processing of this data at any time for reasons arising from your particular situation. We will then no longer process this personal data unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves the establishment, exercise or defense of legal claims.<\/p>\n<p>d. Right to withdraw consent If the processing is based on consent, you have the right to withdraw your consent at any time without affecting the lawfulness of processing based on consent before its withdrawal. To do so, you can contact us at any time using the details provided above.<\/p>\n<p>e. Right to erasure You have the right to obtain from us the erasure of personal data concerning you without undue delay and we are obliged to erase personal data without undue delay where one of the following grounds applies:<\/p>\n\u2013 The personal data is no longer necessary for the purposes for which it was collected or otherwise processed.<br \/>\n\u2013 You object to the processing, and there are no overriding legitimate grounds for the processing.<br \/>\n\u2013 The personal data was processed unlawfully.<br \/>\n\u2013 The erasure of personal data is necessary to comply with a legal obligation under Union law or national law. This does not apply if the processing is necessary:<br \/>\n\u2013 to comply with a legal obligation that requires processing under Union or national law;<br \/>\n\u2013 to assert, exercise, or defend legal claims.\nf. Right to restriction of processing<br \/>\nYou have the right to request that we restrict the processing of your personal data if: \u2013 you contest the accuracy of the personal data, for a period that allows us to verify the accuracy of the personal data; \u2013 the processing is unlawful and you oppose the erasure of the personal data and instead request the restriction of its use; \u2013 we no longer need the personal data for the purposes of processing, but you need it to assert, exercise, or defend legal claims, or you have objected to the processing, as long as it has not yet been determined whether our legitimate grounds override yours. If processing has been restricted pursuant to this subparagraph (f), such personal data\u2014apart from its storage\u2014may be processed only with your consent or for the purpose of asserting, exercise, or defense of legal claims, or to protect the rights of another natural or legal person, or for reasons of an important public interest of the Union or a Member State. If you have obtained a restriction on processing, we will notify you before the restriction is lifted.\ng. Right to File a Complaint<br \/>\nWithout prejudice to any other administrative or judicial remedy, you have the right to lodge a complaint with a supervisory authority, in particular in the Member State of your habitual residence, place of work or place of the alleged infringement if you consider that the processing of personal data relating to you infringes the GDPR.\n<strong>8. NECESSITY OF PROVIDING PERSONAL DATA<\/strong><br \/>\nThe provision of personal data is necessary for the conclusion of a contract of employment with us and the associated application process pursuant to Art. 6 para. 1 lit. b) GDPR.
